Terms and conditions
The "complete contract" is the documents that set out the "terms and conditions",and the "rental agreement" and all other details relevant to a particular agreement and is referred to as the "contract". In the agreement the "supplier" also known as the "owner" is HavaHire ltd. The "Hirer" also known as "customer" is person(s),company or business taking the suppliers equipment on hire. The "equipment" is the hired item(s) supplied to the hirer from the supplier as detailed in the rental agreement. The period of hire, security deposit and the hire charge are detailed in the rental agreement.
HavaHire agree to hire equipment to the hirer(s) named on the rental agreement subject to satisfying any credit reference, proof of identity and residence checks.
The hirer is responsible for the correct use of the equipment as stated in the user manual accompanying the equipment.
Havahire ltd is not responsible for any accidents or injuries how so ever caused while using the equipment.
The customers agree to the full terms and condition written herein on the signing of the delivery documentation and the acceptance of equipment on delivery.
The "Hirer" will pay the hire charge as stated in the contract. The hire charge will commence from the date of delivery, and will continue during the period of hire until the equipment is returned to the supplier in a clean and undamaged satisfactory condition. All time is chargeable including weekends and bank holidays etc. Hire charges are payable in advance of hire, minimum rental period is four weeks unless previously agreed and stated on the rental agreement. Charges beyond the original period of hire shall continue at the weekly rate until the equipment is returned to the supplier. The hirer must make available for collection the equipment on termination of the contract, the hirer will be responsible for the rental fees until collected by the supplier.
The "Hirer" will pay a security deposit as set out in the rental agreement to the supplier. The deposit will be held by the supplier until the end of the contract and return of equipment in satisfactory condition.The deposit is against default by the hirer against missed rental payments, loss or damage to the equipment.The deposit will be returned within one week after collection.
The "hirer" will pay the delivery charge as stated on the agreement. The delivery charge includes collection of the equipment.
During the minimum hire period and any time after that hire the hirer can choose to exchange their equipment for another item, if it is within the four week minimum hire period it may incur a delivery charge, after the minimum hire period as stated on the agreement no charge would apply and is freely exchanged. A new minimum hire period and contract would precede the new equipment as a new contract from day of delivery and take into account any difference in the hire cost.
The hirer can terminate this agreement by giving seven days notice in writing after or seven days before the minimum contract period ends, and arranging the collection of equipment.
Before delivery the hirer must ensure there is enough space in a suitable, dry secure area equipped with relevant power supplies if required. Equipment can only be delivered to ground floor locations unless agreed in advance with the supplier and written on the agreement. It is the hirers responsibility to ensure there is adequate access to deliver the equipment. Whilst every care will be taken during delivery, HavaHire cannot be held responsible for any accidental damage caused to property when delivering and collecting equipment.
HavaHire will maintain the equipment, the hirer must let us know when any maintenance is required and notify us of any faults immediately so any repairs can be made within 5 working days, if a repair is unpractical or takes longer than the 5 days replacement equipment will be supplied.
Should the equipment fail due to misuse of the hirer, the owner reserves the right to charge the hirer for the repair. Under no circumstances shall the hirer attempt to repair the equipment.
The hirer is responsible for the day to day maintenance of the equipment replacing batteries(at your expense), user adjustments such as seat, handlebar and pedal movements and any adjustments in the user guide.
Manufacturer instructions will be provided by the supplier with all equipment. The hirer must read these carefully before using the equipment and adhere to these and any additional instructions supplied when using the equipment.
All equipment remains the property of HavaHire ltd at all times.The hirer agrees to keep the equipment safe, cannot sell, pledge or assign or part with possession of the equipment.
This is the address as on the rental agreement, the equipment must not be moved from this address without prior written permission from HavaHire.
Insuring the equipment
The hirer must check with their insurance provider to ensure the equipment is fully insured at their property, against all loss of ,or damage however caused. It is responsibility of the hirer to keep the equipment insured.
The hirer accepts full responsibility of the care and safe keeping of the equipment. If the equipment is lost, damaged beyond economic repair, or stolen, then the hirer shall pay the supplier on demand the full replacement costs.
Conditions of Hire and Use
HavaHire ltd and its staff are not qualified fitness instructors and cannot give advice on health issues. We can only give instructions on the use of hired equipment, the use of it is at the customers own risk.
HavaHire do not manufacture any of the equipment and cannot be held responsible for accidents and injuries caused by its use.
The customer must ensure he/she or anyone using the equipment at the delivery address is capable of undergoing a fitness routine. HavaHire recommends that they consult their doctor before commencing any physical training program.
The customer must ensure the equipment is of the right specification adhering to maximum weight and height restrictions on some equipments. Ensuring all users under their supervision are aware of this and operating instructions.
We recommend that all new customers consult with their doctor, before embarking on a new exercise regime.
